I like this. She's being taken away from a non-Native family who's been trying to adopt her for the last 2 years so she can be placed with another non-Native family who doesn't live on a reserve. And all because the girl has a tiny fraction of Native DNA.
Yeah, this makes sense.

ON top of it all, isn't it just a little racist to demand that someone who is only 1.5% Native American be taken from a family who isn't Native American?
The little girl may have 1.5% Choctaw DNA but she's NOT Choctaw. Hell, most humans have around 2-4% Neanderthal DNA, I guess that makes them actual Neanderthals, right?

I see why you don't want to give a link to that one. There's a few differences, aren't there?

The family and the girl are what the CBC repetitively insists we call 'Metis'. I believe the legal definition of Metis is there should be at least 1/4 Indian blood. I know people who jump through the paperwork hoops to make the metis claim for the perks.

The girl is 2 not 6. MCFD wants to move the toddler to a couple who are raising her two siblings. The province is arguing that the couple are legal strangers. It is not an insistence on taking a 6 year old from the parents she has known her whole life who have wanted to adopt her for some time. The baby girl is not just 1% native and the claim does not center on her aboriginal status.

Unless you're talking about the case where the Squamish band claimed authority over some foster kids, but that one's different too.

The girl's sister is living with the couple, and another sister will be living down the street, said Leslie Heimov of the Children's Law Center of California, Lexi's court-appointed legal representatives.

"The law is very clear that siblings should be kept together whenever they can be, and they should be placed together even if they were not initially together," Heimov told the Daily News.

She said the girl and the Utah family had traded messages and monthly visits over the past three years.

"She has a loving relationship with them," Heimov said. "They are not strangers in any way, shape or form."

SOP here in Alberta too.

I know a foster family (not FN) who raised an aboriginal kid from a few months old to three and were working to adopt him when his distant relatives suddenly realized the $1000/month pay cheque they were missing out on and had Child Services yank him out and drag him to the res (against his will).

It took the foster family almost four years to get him back (during which time Child Services slandered them and was found in contempt of court by the ombudsmen) and the boy has since been assessed a learning disability and speech impediment. Still, he's back in a caring environment and showing signs of progress.
