I see why you don't want to give a link to that one. There's a few differences, aren't there?
The family and the girl are what the CBC repetitively insists we call 'Metis'. I believe the legal definition of Metis is there should be at least 1/4 Indian blood. I know people who jump through the paperwork hoops to make the metis claim for the perks.
The girl is 2 not 6. MCFD wants to move the toddler to a couple who are raising her two siblings. The province is arguing that the couple are legal strangers. It is not an insistence on taking a 6 year old from the parents she has known her whole life who have wanted to adopt her for some time. The baby girl is not just 1% native and the claim does not center on her aboriginal status.
Unless you're talking about the case where the Squamish band claimed authority over some foster kids, but that one's different too.
