Rape is a huge accusation, and I don't think it is appropriate here in the first place, BUT, spreading your legs doesn't always mean consent to everything...

agreed. ..and sorry for the crude analogy. it was a rough way of saying that the 'assault' part was dead in the water. (except for the hiv part: that might be a lockdown on a sex assault charge, but a different sort.)
$1:
But doesn't that go for every rape victim then who has been fed GHB? From what I read, they are out and have no recollection...

not sure. (in this case, i don't think the other woman plied her with alcohol.) in the case of ghb or other aggravated drug rapes: you're right, they're out- completely unconscious. if they are lucky enough to remember something bad happened, they could get a rape kit done at the hospital and catch some dna. i think that's pretty much essential to lock down a charge.

The HIV part is criminal, and should be a separate charge. That alone should be enough to lock someone up for a long time, because it's a form of attempted murder. A slow one, but nevertheless... Then again, that is my opinion, not a fact (before I get slapped about that again )

billypilgrim billypilgrim:
regardless, the 'victim' in this may have killed her own lawsuit by acknowledging that she was "too drunk to...." ..the problem is that that sentence can be completed with all sorts of things, especially, "..to remember much of what happened, actually."
Are you forgetting this was caught on video and there were witnesses? Being to drunk by no means kills her lawsuit.

nope, not forgetting about the video part. ..that'll probably make things worse for her, actually...

as for the 'witnesses', i prefer to call them 'scum sucking voyeur bastards' who should be fired or worse.

i think the only criminal charge that'll stick in any of this is the one vis a vis the HIV.

i totally understand why the lawsuit was borne out of all this. these women must be horrified knowing that they were watched like so much pornography, without even knowing it until later. i can't imagine the embarrassment... but to base it all on an issue of 'consent', i think, is a mistake. ..but what the hell do i know..

I don't have a lot of sympathy for either woman. Anyone who gets that wasted has to take responsibility for it.

bang on man.

the sick, aggravating parts of the story are terrible consequences for sure.. but, poisoning yourself into a half-conscious stupor will never turn out good. this is something all adults should know.

buy the ticket, take the ride.
