Sorry lady that 24 hour 365 day a year defense has been used before and rather unsuccessfully.

They should ask her why she's so special. If military personnel who weren't actively standing a watch or participating in a specific military requirement during their 24 hour 365 day a year job when they got hurt can't claim that defense, WTF should does she think she should be entitled to it.
