If a Canadian is involved in killing one of our soldiers, then yes. That's what this boils down to. A Canadian citizen being tried in a kangaroo court (even the Republican dominated Supreme Court considers it a farce).

If by some stroke of luck (his good ours bad) this little shite got repatriated, I'm pretty sure that our illustrious judicial system backed by his left wing supporters, would let him be tried as a young offender or at the very least a child soldier, which, with time served in Gitmo would likely mean his release soon after.

This is still a US lead court and they get first crack at him. If we get him, I doubt the'll do more than house arrest and he'll be out. How about this for a possible way to win something out of this mess.

I'm thinking he's probably had the Muslim drilled out him and as long as he's removed from his family and those idiots, I doubt he's much of a risk to re-offend or even continue.
What I'm suggesting is they charge, prison, release with tight restrictions but we turn him into one of the people who muslims hate the most, folks like Ayaan Hirsi Ali who were muslims but renounced Islam it in the most public ways. If he gets on the news or talk shows, telling his story of how his zelot family made him become a child soldier for a crazy religion, then actively speaks out against it.. That would be a huge PR coup.
