Yet another incident where the actual criminal will not be held accountable for his actions. Someone else will be punished for HIS crime, he'll grow up blaming everyone around him for everything that goes wrong in his life, and no one will be able to figure out why.

Criminal charges were filed against the bully, as far as that goes (and not far with our YOA but still charged). Schools should be held accountable in cases like these, there were people of authority in place that could have acted to stop it.

So let me get this straight. We can charge people for not applying due dilligence when there's and environmental accident, but teachers have to stand by and watch an assault take place without interceeding?

Not in any school I went to, I've seen teachers physically pull fighters apart. My wife is a special Ed aide and she is taught passive restraint techniques to stop kids from hitting. There are legal ways to stop this kind of thing and the teachers should have been aware of them. Plus alot of schools have bully campaigns these days for dealing with these situations, and they do involve physical contact to seperate kids.
In my day there were bullies you avoided them got beat up and that was usually the end of it, now it is harassment not bullying . To bad we seem to think this level of violence is some what acceptable today, and do nothing to stem it just blame people . Why is it the kids are so into violence to solve things

Because the school didn't stop it. The teacher was in a position to stop it, didn't, and are accountable.

"Position to stop it" I would like to know what position that was, I have been on the receiving end of bully attacks. Often by the time a teacher has the chance to intervene the damage has already been done. Attacks can last only seconds, and bullies do NOT listen to teachers, so until I know know more details I don't think the school is responsible. Also it is near impossible for schools to deal with bullies who want to be bullies my school was unable to do anything, until me and two of my friends ended up in the hospital after we were swarmed. Even then only 2 of the 15 people who swarmed us were expelled.

our shop teacher was very clear with us. if he found us playing around unsafe equipment, he was instructed to hit, push or slam us in any way that gets us out of the unsafe condition.
The school division is being named as the defendant because, according to the suit, "the plaintiffs say that both the teacher and the educational assistant were in a position to intervene and failed to do so."

Okay, the plantiffs statement, if accurate begs the question. Why aren't the teacher and teachers assistant being charged since they allegedly watched the whole thing transpire and did nothing to stop it?
I can't help but get the feeling we're not hearing the whole story. Everything is based on the plantiff's claims, which quite obviously are being used to coroborate her law suit.
Most parents would want justice for their child before immediate monetary compensation. If she was really serious about taking the bully, the school district and the teachers to task for this incident, you'd think she'd could wait until after the trial to seek financial retribution.
