A former Winnipeg man is suing the Winnipeg Police Service and Manitoba Justice for $5 million, alleging he was the victim of racial profiling and malicious prosecution.

He got lucky once. The Crown should continue the investigation, resurect the charges and put this asshole in jail where he belongs.
It would be my guess that he started screaming racism as soon as the Winnipeg Police Services started the investigation and the Crown likely figured it wasn't worth the effort to proceed with the arson charge.

This was touched on in another thread about a PR who did a shooting after years of other arrests. Yes, as I recall from my time at CIC part of their ability to stay here as guests (Permanent Residents) is they cannot get charged with crimes or face the possibility of deportment. Where is gets hard is lack of will politically, lack of resources to hunt them all down, and infinite appeals which would often end up the deportation being over turned on humanitarian and compassionate grounds.
In short some pencil neck has done a cost benefit calculation and decided its cheaper for CIC / CBSA to let them stay. I wonder though how one calculates the degradation of society by letting too many criminals stay. We are stuck with our enough citizen convicts as it is.
Even those with criminal records get accepted for a number of stupid reasons. Its very frustrating doing Migration Integrity at CIC / CBSA as you're refusals are often overturned and criminal records either ignored as "no big deal" or if the dope is conveniently married to a citizen, well we can't keep him from his or her spouse due to simple assault charges of mere "Suspicion" of criminal activity or terrorist ties.

Conviction of a criminal offence should mean deportation of the convicted once their sentence has been completed. If they want to appeal they can appeal the conviction, but if the conviction sticks deportation should be automatic.
The charges were stayed by the Crown in 2008. Sam alleges Crown prosecutors asked him to sign a document stating �I didn�t think that charges were racially motivated.�
Ie he was never convicted, so he got his citizenship. It sounds like it's the prosecutors who dropped the ball on this one - they were so afraid they'd be accused of profiling they dropped the charges as long as he signed that paper. But, since he signed that the charges were not racially motivated, they should ram that document down his throat and tell him to get the fuck out of the courtroom now. (ie drop the lawsuit if that wasn't clear.)
