Using your argument on the other thread, I don't think this would stick. I also don't think it's really in the same league as the other. The other incident had someone aggressively challenging the driver whereas here I don't think the driver opened the door knowing she was coming. Now if he did, and the Crown can prove it, then by all means he should be looking at jail time.
